New Hampshire Supreme Court Rules in Favor of Freedom Energy Logistics’ Legal Battle with Provider Power
Auburn, N.H., After a lengthy legal battle with Freedom Energy Logistics competitor, Provider Power, in a unanimous decision the New Hampshire Supreme Court recently upheld a Superior Court jury’s decision to award Freedom Energy Logistics with more than $800,000 in damages and attorneys fees.
The Supreme Court ruling ends Provider Power’s appeal that started after a Superior Court Jury found the Auburn, Maine owner of Electricity Maine, and its owners guilty of stealing confidential customer lists, sales leads and other proprietary information from Freedom Energy Logistics.
“We were always confident that the Supreme Court would agree with the same verdict that the Superior Court Jury initially ruled,” said August G. The initial unanimous Jury verdict in the civil lawsuit and the Judge’s subsequent ruling was handed down in May 2016. The two-week trial in Rockingham County Superior Court found owners Emile Clavet, Kevin Dean and their three energy supply and brokerage firms – Provider Power, ENH Power and Electricity Maine guilty. According to the lawsuit, Provider Power hired a Freedom Energy Logistics employee to work for them, while remaining employed with Freedom – Clavit and Dean coached the employee to obtain sensitive customer and pricing information from Freedom and then transfer that over to Provider Power to use for their means.
